| Abstract: | This paper analyzes the legal aspects related to privacy and library records. Although the United States Congress has yet to declare library records confidential, the U.S. Supreme Court has recognized a general right to privacy in the penumbra surrounding the First, Fourth, Fifth, and Fourteenth Amendments. This paper includes a review of the relevant cases and legislation. Particular attention is paid to the USA PATRIOT Act and the proposed 2005 amendments to the Act and how they affect the confidentiality of library records. Finally, it attempts to formulate an argument for establishing a constitutional right to read and use libraries anonymously. |
